Membership of the club & benefits. (HHTC)
Those who have already travelled with us get automatic membership of this Club and will be issued a Card with their Membership Number, ABSOLUTELY FREE!!! This entitles the Members to many benefits such as Free Travel / Deep Discount Tours, Lucky Draws, and a FREE get-together at a Cruise in Mumbai Harbour, with Dinner, as announced from time to time.
POINT SCHEME:
The company has come out with a scheme to grant point to HHTC Members,which can either be enchased or adjusted,against future Tours.
OPERATION OF POINTS SCHEME:
1) The Members will get Points as given below, when the person/s referred by them goes on one of our Tours.

• For a Tour of minimum 5 Nights.
2) The points are credited to one’s Account when the Tourist who is referred confirms his/their participation in the Tour by filling up the Participation Form,with the existing Members Number on it, and pays the necessary charges.
3) Each Point is equal to Re1/-
4) One can accumulate the Points and redeem them in two ways: -
a. Encash them OR
b. Adjust them against future Tours.
5) Encash – As and when encashment is asked for,the amount equivalent to the Points is paid to the Member.
6) Adjustment against future Tours - As and when a Member wishes to take our Tours in the future, He/She will be entitled to discounts to the extent of cash value of the Points, plus an addition bonus of 50 % of cash value of the accumulated Points. In case of the family members travelling with the Member Tourist,an additional discount of 5% per family member can be claimed.
7) The points are transferable amongst the family members.

Brochure Accuracy:
This brochure along with the Tour Tariff is published on 1st Aug 2004. All previous Brochures, letters and any other modes of circulation stand cancelled. Every effort is made to ensure Brochure accuracy at the time of going to press, based on the available information. We reserve the right to change any brochure information before or after a tour is booked due to any events beyond our control. Tour Itinerary, Tour price, departure dates and Hotels are subject to change. If we are aware of these changes sufficiently beforehand, we will inform you at the time of booking, otherwise our Tour Escort or Local Representative will inform you of the changes on the Tour.
Scope of Activity:
We are basically Travel and Holiday Organisers. We do not control or operate any Airline or any other mode of transport like Shipping, Railways, Cars, Buses etc. We also do not own or control any Hotel,Transport or other facility or the services mentioned in this brochure. We take utmost care in selecting all the factors for making your Holiday comfortable and enjoyable. We only select, but do not have any control in their running or functions. Therefore, we are not responsible for any injury, loss, personal harm, death or damage to the person/s or property which may be caused by or on account of any act or omission or default on the part of the management or employees of any independent contractor, arising out of our normal selection or inspection selection.
It is imperative for all the Tourists who are joining our Tour and those who are FIT (Free individual travel) to abide by and strictly comply and observe all the terms and conditions laid down herein.
Definition:
a. Client means the persons/persons in whose the persons name or whose behalf the booking is made.
b. Company means "HOLIDAY HIMALAYA"
c. Independent contractors means "any hotelier/hotel owner owner of any airlines or shipping company or Railway Ferry Boat owner/operator/or any other person or organization who have been selected by the company to render services to the tour participant"
1. Legal discretion of the company:
a.There is no contract between the company and the client has received the appropriate deposit. The full payment must be received in accordance with procedures laid down in the payment term. If not paid within that time, the company reserves the right to cancel the booking with consequent loss of deposit and apply cancellation charges as mentioned in this brochure.
b.The company has full discretion to cancel the application of any of the designing the participants without assigning any reasons after acceptance of the deposit but prior to commencement of the tour. In the event the company terminates the contract, the company may refund the deposit without payment of any interest.
c. All disputes pertaining to the tour and travel conducted by the company and any crimes arising there under shall be Subject to Mumbai jurisdiction only.
d.The company shall be entitled to amend, alter, vary or withdraw any tour holiday facility it has advertised or published or to substitute a hotel or air journey, railway journey, bus journey, commencement of the tour or date etc. for the reasons which may be deemed fit and proper by the company and the participants shall have no rights to raise any dispute regarding the same.
e.Similarity, on account of political disturbance, epidemic, natural calamities for security problems if the company changes its route or make any amendments in the programs either from the point of view or security or otherwise, the participants shall be bound by the same. No complaints that regarding will be entertained by the company.
f. After commencement of the programs if the tour is to be cut short for political or other reasons or if in the program is to be curtailed before the due period and the company is compelled to bring the participants back to Mumbai, the participants shall not be entitled to ask for any refund of the charges. The participants shall not be entitled to have any say regarding the changes in the programme.
g.Any claim or complaint by the client must be notified to the company in writing within 14 days of their end of the tour. No claim notified to the company outside this period will be entertained and the company shall incur no liability in respect thereof.
h.The company shall operate all tours with a minimum group size of 15 adults paying passengers in each group. If the group strength falls below 15 passenger then company reserves the right to prepone/postpone/merge or cancel the tour. If the tour is cancelled due to above reasons the money paid by passengers will be refunded against the receipt copies.
2. No person other than the company, in writing has the authority to vary, add, amplify or valve any stipulation, representation term or condition in this brochure.
3. In the event of the company exercising its right to amend or alter any of the services mentioned in the itinerary, after such tour and holiday has been booked, the client shall have the right.
a.To continue with the tour option or holiday which the company may offer.
b.To accept any alternative tour option the holiday, which the company may offer.
In either case the client shall not be entitled to, or the company shall not be liable to the client for any damage additional expense consequences loss suffered by him or to pay any amount as refund.
4.No liability or part of the company arising in way out of this contract in respect of any tour, holiday, excursion facility shall exceed the total amount paid or agreed to be paid for the tour and shall in no case include any consequential loss or additional expense whatsoever.
5. Independent contractor services: The liability of the company is restricted to the making of the reservation in accordance with the passenger’s requirements. The company will cease on the issue of a ticket reservation and travel document to the customer. The company is not liable to the client for any loss of persons or property caused or damaged or suffered by the customer on account of deficiency in services by any independent contractor. Any gesture of courtesy extended by the company to the passenger to minimize such loss or damage will not constitute an admission of such liability or a wavier.
6. It is hereby declared that the immunities provided under the contract shall be available to the company’s manager including tour escort’s employee’s service and agents but not the independent contractors selected by the company.
7. If the client has any complaint in respect of services provided by the independent contractors the tour participants should immediately notify the same independent contract and a copy thereof should handed over to the tour manager.
8. Loss of property or life
The company shall in no circumstances whatsoever be liable to the client or any other person travelling for:
a. Any death, personal injury, sickness, accident, loss, delay, discomfort, increase expenses, consequential loss and/or any damage to baggage or personal effects however caused.
b. With respect to any change in flight schedule or meals not being not being served, expenses for the same have borne by the passengers.
c. For the delay or changes in the train, bus, airplane or ship or other services, sickness, weather conditions or strike, war, quarantine, or any other cause whatsoever. All the loss or expenses will have to be borne by the passenger.
9. Booking and payment in terms:
a. The booking form must be duly filled and signed by the client.
b. At the time of booking each person have to pay a non-refundable deposit of Rs.7000 for Indian tours & Rs.10000/- for international tours by cash cheque or DD in favour of” Holiday Himalaya” payable at Mumbai along with the cost of rail or other rail tickets and any optional programme. The balance amount should be paid 30 days prior to the date of departure of the tour. If the person fails to make payment in the stipulated time, the entire amount paid at the booking shall deemed to the cancellation charges and fortified and the passenger shall not be entitled to the refund for the same.
c. Passenger has to clear entire billing amount before departure of the tour or travel.
d. Personal cheque is not acceptable 15 days prior to departure.
